These Terms of Service (“Terms”) govern the use of Host Machines LLC (“Host Machines,” “we,” “our,” or “us”) services, vending machines, website, and related products (collectively, the “Services”). By accessing our website, using our machines, or entering into an agreement with Host Machines, you agree to these Terms.

If you do not agree, do not use the Services.

1) Eligibility & Age Restrictions (21+)

Host Machines provides age-restricted nicotine products intended only for individuals 21 years of age or older.

By using our Services, you represent and warrant that:

Host Machines retains ownership and control of all machines unless otherwise specified in a written agreement.

3) Venue Partner Responsibilities

Venue partners agree to:

Provide appropriate placement space for machines
Provide access for servicing, restocking, and maintenance
Provide a Wi-Fi connection where required for machine connectivity and operations
Comply with all applicable age-restricted product regulations
Not interfere with machine operation or age-verification systems

Venue owners are not responsible for machine operation, compliance enforcement, or inventory handling, except as may be stated in a written venue agreement.

4) Payments, Revenue Share & Transactions

All transactions are processed electronically through secure payment systems.

Revenue sharing terms are governed by the individual venue agreement.
Host Machines is responsible for tax collection and reporting unless otherwise stated in writing.
Host Machines is not liable for temporary outages due to maintenance, connectivity, equipment issues, venue network issues, or force majeure events (including but not limited to weather events, power failures, internet outages, or acts beyond our reasonable control).

5) Refunds & Disputes

Refund requests must include:

Issue description
Location of purchase
Product name
Date and approximate time of transaction

Host Machines reserves the right to approve or deny refunds based on transaction verification and policy compliance. Where a refund is approved, processing times may vary depending on the payment provider.

6) Prohibited Conduct

You agree not to:

Attempt to bypass age-verification systems
Tamper with or damage machines
Use machines for unlawful purposes
Resell products purchased from Host Machines
Provide false or misleading information
Attempt to access, probe, or disrupt Host Machines software systems, networks, or monitoring tools

Violations may result in denied service, immediate suspension of access, and legal action where applicable.

7) Health Disclaimer & Assumption of Risk

Nicotine products are not risk-free and may be addictive. Host Machines does not provide medical advice and encourages users to understand the risks associated with nicotine consumption.

Assumption of Risk: By purchasing and using products from Host Machines, you assume all responsibility for their lawful and safe use. Host Machines is not liable for misuse, health complications, or usage by unauthorized third parties after purchase.

8) Intellectual Property

All trademarks, logos, machine designs, software, and content are the exclusive property of Host Machines LLC and may not be used without our prior written permission.

9) Limitation of Liability

To the maximum extent permitted by law:

Host Machines is not liable for indirect, incidental, special, consequential, or punitive damages
Our total liability for any claim related to a specific transaction is limited to the amount paid for that transaction
Host Machines is not responsible for misuse of products by customers

10) Indemnification

You agree to indemnify and hold harmless Host Machines LLC, its owners, officers, employees, contractors, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your violation of these Terms
Your misuse of products or Services
Your violation of age-restriction laws or other applicable laws
Your interference with machine operations or compliance systems

11) Termination

Host Machines reserves the right to suspend or terminate access to Services at any time for violations of these Terms, suspected fraud, misuse, tampering, or other conduct that we believe may create legal, operational, or reputational risk.

12) Marketing Compliance

Communications from Host Machines are for business and transactional purposes. Users may opt out of non-essential marketing communications. Host Machines does not target marketing to minors and complies with applicable tobacco/nicotine advertising laws.

13) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

14) Changes to Terms

Host Machines may update these Terms periodically. Updated Terms will be posted on our website with a revised effective date. Continued use of Services after updates constitutes acceptance of the updated Terms.
